Tier 1 Entrepreneur Refusal

IN THIS SECTION

The Tier 1 Entrepreneur visa has closed to new applications but remains open for a limited period for Tier 1 Entrepreneur visa extension and settlement applications for existing visa holders under the old route. New applicants should consider the new Innovator route.

Has your Tier 1 Entrepreneur Visa application been refused?

The Tier 1 Entrepreneur visa is designed to support foreign individuals to come to the UK to start a business. Concerns however about abuse of the Tier 1 visa have led to more stringent eligibility criteria, resulting in a significant reduction in application success rates.

The Tier 1 Entrepreneur visa has the highest application refusal rate of all UK visa classes outside of asylum. But there is recourse for appeal, particularly in light of a recent court ruling criticising the format of Home Office Tier 1 Entrepreneur application interviews.

If you are facing a Tier 1 Entrepreneur visa refusal, DavidsonMorris can advise on your next steps.

Depending on the grounds for refusal, it may be advisable to start again and make a new application. In other circumstances, such as errors of fact or where there are issues arising from your Home Office interview, it may be possible to appeal the decision via an Administrative Review.

With so much at stake, it is important to seek legal advice to understand the options open to you; be that making a new application, appealing the Home Office decision, or considering alternative immigration routes.
